Welcome to frostpunchlabs.com. These Terms & Conditions ("Terms") govern your use of this website and the services provided by FrostPunchLabs ("we," "us," or "our"). By accessing this website or engaging our services, you agree to these Terms.
Services
FrostPunchLabs provides 3D product visualization, animation, and related creative services. All projects are custom work and are subject to a separate Project Agreement that outlines specific deliverables, timelines, revisions, and pricing.
Inquiries and quotes
Submitting an inquiry through our contact form does not create a binding agreement. A project only begins once both parties have agreed to the scope, pricing, and terms outlined in a Project Agreement, and full payment has been received.
Payment
All projects require full payment (100%) before work begins. Payment terms, methods, and amounts are specified in the Project Agreement provided for each project. Late or missing payments may result in project delays or cancellation.
Revisions
Each project includes a set number of revision rounds as defined in the Project Agreement. Additional revisions beyond what is included may be subject to additional fees. Major scope changes (new products, change in creative direction, adding animation to a stills-only project, etc.) are not considered revisions and require a separate quote.
Refunds
Refunds are handled in accordance with our Refund Policy. In summary: full refund before work begins, 50% refund during early production, and no refund after the first draft has been delivered. Full details are available on our Refund Policy page.
Intellectual property
Upon receipt of full payment and final delivery, the client receives full commercial usage rights to all final delivered assets (images and videos). FrostPunchLabs retains ownership of all 3D source files, project files, models, scenes, and textures unless explicitly agreed otherwise in writing. FrostPunchLabs also retains the right to showcase completed work in our portfolio, website, and social media unless the client opts out in writing.
Confidentiality
We treat all client materials, product details, and project specifics as confidential. No information will be shared with third parties without the client's written consent. Clients may request full confidentiality and opt out of portfolio usage through the Project Agreement.
Client responsibilities
By engaging our services, you agree to:

Provide necessary reference materials, brand guidelines, and project details in a timely manner

Respond to revision requests and approvals within 5 business days

Consolidate feedback into a single message per revision round

Not publish or distribute any work-in-progress drafts or watermarked previews
Delays in providing feedback or materials may affect the project timeline.
Project abandonment
If a client becomes unresponsive for more than 14 consecutive days during an active project without prior notice, the project may be considered abandoned. No refund will be issued in this case.
Limitation of liability
FrostPunchLabs' total liability under any project shall not exceed the total project fee paid by the client. We are not liable for any indirect, incidental, or consequential damages arising from the use of delivered assets. We are not responsible for how the client uses final assets after delivery, including any legal issues arising from trademarks, brand names, or product likenesses the client does not own.
Website use
You may browse this website for personal and commercial research purposes (such as evaluating our services). You may not copy, reproduce, or redistribute any content, images, or media from this website without our written permission. All portfolio work, renders, animations, and visual content displayed on this site are the property of FrostPunchLabs or used with client permission.
Third-party services
Our website is hosted on Wix and uses third-party tools including Google Workspace. These services operate under their own terms and privacy policies, which we do not control.
Changes to these terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated date. Continued use of the website after changes constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Florida, United States.
